Kullanım Şartları

Madde 01Taraflar ve kabul

Bu şartlar, EasyKey360 uygulaması ve easykey360.com üzerindeki hizmetleri sunan taraf (“biz”) ile hizmeti kullanan kişi (“siz” veya “kullanıcı”) arasındaki sözleşmeyi oluşturur.

Hesap açtığınızda veya hizmeti kullandığınızda bu şartları ve Gizlilik Politikası'nı kabul etmiş sayılırsınız. Kabul etmiyorsanız hizmeti kullanmayınız.

Madde 02Hizmetin tanımı

EasyKey360, emlak danışmanları için bir müşteri ilişkileri yönetimi (CRM) hizmetidir. Başlıca işlevleri:

Portföy (ilan) ve müşteri kayıtlarının tutulması, aranması ve eşleştirilmesi;
Hatırlatma, takip ve kampanya adımlarının planlanması;
Kullanıcının kendi e-posta hesabı üzerinden otomatik e-posta gönderimi;
Kullanıcının bağladığı Instagram işletme hesabındaki mesajların (DM) yönetimi ve gönderi paylaşımı;
İlan PDF'i, katalog ve paylaşım bağlantısı üretimi; meslektaşlarla izin bazlı paylaşım.

Hizmetin kapsamı zaman içinde değişebilir; işlev ekleyebilir, değiştirebilir veya kaldırabiliriz. Önemli bir kaldırma işleminden önce sizi bilgilendiririz.

Madde 03Hesap ve güvenlik

Hesap açmak için 18 yaşını doldurmuş ve mesleki faaliyet yürütüyor olmanız gerekir.
Kayıt bilgilerinin doğru ve güncel olmasından siz sorumlusunuz.
Şifrenizin gizliliği ve hesabınız üzerinden yapılan tüm işlemler sizin sorumluluğunuzdadır. Yetkisiz bir erişim fark ederseniz derhal bize bildirin.
Hesabınızı başkasına devredemez, birden fazla kişiyle paylaşarak tek lisanstan çoklu kullanım yaratamazsınız.

Madde 04Ücretlendirme

Hizmet şu anda ücretsiz olarak veya deneme kapsamında sunulmaktadır. İleride ücretli planlar başlatılırsa:

Fiyatlar ve plan kapsamı yürürlüğe girmeden önce duyurulur; mevcut kullanıcılara en az 30 gün önceden bildirim yapılır.
Ücretli bir plana geçiş yalnızca sizin onayınızla olur; onay vermezseniz hesabınız ücretsiz kapsamda kalır veya kullanımınız sonlandırılır.
Aksi belirtilmedikçe ücretler peşin tahsil edilir ve kullanılmış dönem için iade yapılmaz.

Madde 05Kabul edilebilir kullanım

Hizmeti kullanırken şunları yapmamayı kabul edersiniz:

İzinsiz toplanmış listelere toplu istenmeyen ileti (spam) göndermek;
Hukuka aykırı, yanıltıcı, hakaret içeren, ayrımcı veya üçüncü kişilerin haklarını ihlal eden içerik yüklemek ya da göndermek;
Size ait olmayan ilan fotoğrafı, metin veya belgeleri hak sahibinin izni olmadan kullanmak;
Hizmeti otomatik araçlarla kazımak, tersine mühendislik yapmak, kaynak kodunu çıkarmaya çalışmak, güvenlik önlemlerini aşmak veya sisteme aşırı yük bindirmek;
Başka bir kullanıcının verisine yetkisiz erişmeye çalışmak;
Hizmeti, bağlı olduğu platformların (Meta, Google) kurallarına aykırı biçimde kullanmak.

Madde 06Müşteri verisi sorumluluğu

Uygulamaya girdiğiniz müşteri kayıtları için veri sorumlusu sizsiniz; EasyKey360 bu verileri yalnızca sizin talimatınızla işler. Buna göre:

Müşterilerinizi KVKK kapsamında aydınlatma ve gereken hallerde açık rıza alma yükümlülüğü size aittir.
Yalnızca hukuka uygun şekilde elde ettiğiniz verileri yükleyebilirsiniz.
Müşterinizin silme, düzeltme veya bilgi talebi geldiğinde bunu karşılamak sizin sorumluluğunuzdadır; uygulama bunun için gerekli araçları sağlar.
Özel nitelikli kişisel veri (sağlık, inanç, biyometri vb.) yüklememelisiniz.

Madde 07Ticari elektronik ileti

Uygulama üzerinden gönderdiğiniz e-postalar sizin adınıza ve sizin e-posta hesabınızdan gider. Ticari elektronik ileti mevzuatına (6563 sayılı Kanun ve İYS yükümlülükleri dâhil) uygunluk sizin sorumluluğunuzdadır: onay almak, onayı kaydetmek ve ret taleplerine uymak size aittir.

Otomatik gönderilen her iletiye “listeden çık” bağlantısı eklenir. Listeden çıkan bir kişiye sistem bir daha otomatik ileti göndermez; bu kaydı elle değiştirerek kişiye tekrar ileti göndermeniz doğrudan sizin sorumluluğunuzdadır.

Madde 08Üçüncü taraf platformlar

Instagram/Meta ve Google (Gmail) entegrasyonları isteğe bağlıdır ve ilgili platformun kendi şartlarına tabidir. Bu entegrasyonları kullanırken Meta Platform Şartları ile Google API Hizmet Şartları'na uymayı kabul edersiniz.

Bu platformlar erişimi kısıtlar, kuralları değiştirir veya hizmeti keserse ilgili işlevler durabilir ya da kaldırılabilir. Bu durumdan sorumlu değiliz; ancak sizi bilgilendirir ve mümkünse alternatif sunarız (ör. e-posta gönderimi için kendi SMTP hesabınızı bağlamak).

Madde 09İçerik ve fikri mülkiyet

Yüklediğiniz içerik sizindir. İlan fotoğrafları, metinler, müşteri kayıtları ve belgeler üzerindeki haklar sizde kalır.
Hizmeti sunabilmemiz için bize; içeriğinizi barındırma, işleme, yedekleme, PDF ve paylaşım bağlantısı üretme ve sizin talimatınızla iletme konusunda sınırlı, telifsiz bir kullanım hakkı vermiş olursunuz. Bu hak yalnızca hizmetin işletilmesi için geçerlidir ve hesabınızı sildiğinizde sona erer.
Uygulamanın kendisi — yazılım, arayüz, marka ve içerik şablonları — bize aittir; kopyalanamaz, çoğaltılamaz veya türev çalışma üretiminde kullanılamaz.

Madde 10Süreklilik ve destek

Hizmeti kesintisiz sunmaya çalışırız ancak bakım, altyapı sağlayıcı arızası veya sağlayıcı kaynaklı kesintiler olabilir. Planlı bakımları mümkün olduğunca önceden duyururuz. Destek talepleri için hello@easykey360.com adresine yazabilirsiniz; taahhüt edilmiş bir yanıt süresi (SLA) bulunmamaktadır.

Madde 11Garanti reddi

Hizmet “olduğu gibi” sunulur. Belirli bir amaca uygunluk, kesintisizlik veya hatasızlık konusunda açık ya da zımni garanti verilmez. Uygulamadaki eşleştirme önerileri, fiyat hesapları ve otomatik metinler karar desteği niteliğindedir; hukuki, mali veya mesleki danışmanlık yerine geçmez. Nihai kararların sorumluluğu size aittir.

Madde 12Sorumluluğun sınırı

Yürürlükteki hukukun izin verdiği ölçüde; kâr kaybı, iş kaybı, veri kaybı, itibar zararı gibi dolaylı ve netice kabilinden zararlardan sorumlu değiliz. Her hâlükârda toplam sorumluluğumuz, zararın doğduğu tarihten önceki 12 ay içinde hizmet için bize ödediğiniz tutarla sınırlıdır; hizmet ücretsiz kullanılıyorsa bu tutar sıfırdır. Kasıt ve ağır kusur hâlleri ile mevzuatın sınırlandırılmasına izin vermediği sorumluluklar saklıdır.

Madde 13Tazmin

Hizmeti bu şartlara veya mevzuata aykırı kullanmanız nedeniyle üçüncü kişiler veya resmî merciler tarafından bize yöneltilen talep, ceza ve masrafları karşılamayı kabul edersiniz. Bu özellikle izinsiz veri yükleme ve izinsiz toplu ileti gönderimi için geçerlidir.

Madde 14Askıya alma ve fesih

Siz hesabınızı istediğiniz an kapatabilirsiniz. Kapatma sonrası veri silme süreleri için Gizlilik Politikası'na bakın.
Biz, bu şartların ağır ihlali (spam, hukuka aykırı içerik, sistem güvenliğinin tehdit edilmesi) hâlinde hesabınızı önceden bildirimde bulunmaksızın askıya alabilir veya kapatabiliriz. Daha hafif ihlallerde önce uyarır ve düzeltme süresi tanırız.
Hizmetin tamamen sonlandırılması durumunda en az 60 gün önceden bildirir ve verilerinizi dışa aktarabilmeniz için makul süre tanırız.

Madde 15Değişiklikler

Bu şartları güncelleyebiliriz. Esaslı değişiklikleri yürürlüğe girmeden önce uygulama içinde veya e-posta ile duyururuz. Duyurudan sonra hizmeti kullanmaya devam etmeniz yeni şartları kabul ettiğiniz anlamına gelir; kabul etmiyorsanız hesabınızı kapatabilirsiniz.

Madde 16Uygulanacak hukuk ve uyuşmazlık

Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır. Uyuşmazlıklarda Muğla Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici sıfatıyla kullanımda, tüketicinin yerleşim yerindeki mahkeme ve hakem heyetlerine başvurma hakkı saklıdır.

Article 01Parties and acceptance

These terms form the agreement between the provider of the EasyKey360 application and the services on easykey360.com (“we”) and the person using the service (“you” or “the user”).

By creating an account or using the service you accept these terms and our Privacy Policy. If you do not accept them, do not use the service.

Article 02The service

EasyKey360 is a customer relationship management (CRM) service for real-estate agents. Its main functions are:

Storing, searching and matching property listings and customer records;
Planning reminders, follow-ups and campaign steps;
Automated email sending through the user's own email account;
Managing direct messages and publishing posts on the Instagram business account the user connects;
Generating listing PDFs, catalogues and share links; permission-based sharing with colleagues.

The scope of the service may change over time; we may add, modify or remove features. We will notify you before removing anything material.

Article 03Accounts and security

You must be at least 18 and acting in a professional capacity to open an account.
You are responsible for keeping your registration details accurate and current.
You are responsible for the confidentiality of your password and for everything done through your account. Tell us immediately if you notice unauthorised access.
You may not transfer your account or share it so that one licence serves several people.

Article 04Fees

The service is currently offered free of charge or as a trial. If paid plans are introduced:

Prices and plan scope will be announced before they take effect, with at least 30 days' notice to existing users.
Moving to a paid plan requires your approval; without it your account remains on the free tier or your use ends.
Unless stated otherwise, fees are charged in advance and are not refundable for a period already used.

Article 05Acceptable use

When using the service, you agree not to:

Send unsolicited bulk messages (spam) to lists collected without consent;
Upload or send unlawful, misleading, abusive or discriminatory content, or content that infringes the rights of others;
Use listing photos, texts or documents that are not yours without the rights holder's permission;
Scrape the service with automated tools, reverse-engineer it, attempt to extract its source code, circumvent security measures, or place excessive load on it;
Attempt to access another user's data without authorisation;
Use the service in breach of the rules of the platforms it connects to (Meta, Google).

Article 06Responsibility for customer data

For the customer records you enter, you are the data controller; EasyKey360 processes that data only on your instructions. Accordingly:

Informing your customers and, where required, obtaining their consent is your responsibility.
You may only upload data you obtained lawfully.
Responding to a customer's deletion, correction or access request is your responsibility; the app provides the tools to do so.
You should not upload special-category data (health, beliefs, biometrics and the like).

Article 07Commercial electronic messages

Emails you send through the app go out in your name and from your own email account. Compliance with commercial electronic messaging law — including Turkey's Law no. 6563 and IYS obligations where applicable — is your responsibility: obtaining consent, recording it, and honouring opt-outs are down to you.

Every automated message includes an unsubscribe link. The system sends no further automated message to anyone who opts out; overriding that record and messaging the person again is entirely your responsibility.

Article 08Third-party platforms

The Instagram/Meta and Google (Gmail) integrations are optional and subject to those platforms' own terms. By using them you agree to the Meta Platform Terms and the Google APIs Terms of Service.

If those platforms restrict access, change their rules or discontinue a service, the related features may stop working or be removed. We are not liable for that, but we will inform you and offer an alternative where possible (for example, connecting your own SMTP account for email).

Article 09Content and intellectual property

Your content stays yours. You retain the rights to listing photos, texts, customer records and documents you upload.
To provide the service you grant us a limited, royalty-free right to host, process, back up, generate PDFs and share links from, and deliver your content on your instruction. This right exists only to operate the service and ends when you delete your account.
The application itself — software, interface, brand and content templates — belongs to us and may not be copied, reproduced or used to create derivative works.

Article 10Availability and support

We aim to keep the service running continuously, but maintenance, infrastructure faults and provider-side outages can occur. We announce planned maintenance in advance where possible. For support, write to hello@easykey360.com; no response time is guaranteed (there is no SLA).

Article 11Disclaimer of warranties

The service is provided “as is”. We give no express or implied warranty of fitness for a particular purpose, uninterrupted operation or freedom from errors. Matching suggestions, price calculations and generated texts are decision support only; they do not replace legal, financial or professional advice. Final decisions are yours.

Article 12Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages such as lost profits, lost business, data loss or reputational harm. In any case our total liability is limited to the amount you paid us for the service in the 12 months preceding the event; if you use the service free of charge, that amount is zero. Liability for wilful misconduct and gross negligence, and any liability the law does not allow to be limited, is reserved.

Article 13Indemnity

You agree to cover any claims, penalties and costs brought against us by third parties or authorities as a result of your using the service in breach of these terms or of the law — in particular uploading data without consent and sending unsolicited bulk messages.

Article 14Suspension and termination

You may close your account at any time. For deletion timelines see the Privacy Policy.
We may suspend or close an account without prior notice for serious breaches (spam, unlawful content, threatening system security). For lesser breaches we warn you first and allow time to fix the issue.
If we discontinue the service entirely, we will give at least 60 days' notice and reasonable time to export your data.

Article 15Changes

We may update these terms. Material changes are announced in the app or by email before they take effect. Continuing to use the service after that notice means you accept the new terms; if you do not, you may close your account.

Article 16Governing law

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Muğla have jurisdiction over disputes. Where you use the service as a consumer, your right to apply to the courts and arbitration committees at your place of residence is reserved.
